Terms of Service

1. Acceptance of Terms

By purchasing, installing, or using any Lucky Jade Miner™ product (including the Twin Jade™ J88, associated drivers, and software), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our products.

2. Product Warranty & Telemetry Requirement

2.1 Warranty Coverage

Lucky Jade Mining Corp provides a two (2) year limited hardware warranty from the date of purchase for manufacturing defects and hardware failures under normal use.

2.2 Telemetry Requirement for Warranty

IMPORTANT: Warranty coverage requires active telemetry data transmission.

Your Lucky Jade Miner™ contains a unique hardware UUID that automatically reports performance data to our cloud service. This telemetry is necessary for:

• Verifying product authenticity (anti-counterfeit UUID validation)
• Diagnosing hardware failures remotely
• Validating warranty claims with usage history
• Delivering performance calibration updates

Data automatically collected includes:

• Hardware UUID (unique device identifier)
• Mining performance (hashrate, shares submitted, error rates)
• Hardware health (temperature, voltage, frequency, power consumption)
• System information (operating system, driver version, timezone)
• Approximate location (IP address geolocation to country/region level)

2.3 Consequences of Disabling Telemetry

You may disable telemetry at any time, but understand this may void warranty coverage:

• Warranty claims may be DENIED if telemetry was disabled during the relevant failure period
• We cannot verify product authenticity or diagnose hardware issues remotely
• You will not receive performance calibration updates
• Anti-counterfeit protection is reduced

2.4 Warranty Limitations

This warranty does NOT cover:

• Damage from improper installation, use, or modifications
• Damage from extreme environmental conditions (temperature, humidity, voltage spikes)
• Cards with disabled telemetry (unless specific fault is unrelated to telemetry requirement)
• Counterfeit products detected via UUID validation
• Products used in violation of these Terms
• Normal wear and tear, cosmetic damage not affecting functionality

3. Data Collection and Use

3.1 Automatically Collected Data

Your Lucky Jade hardware automatically transmits telemetry data to api.luckyjademining.com. See our Privacy Policy for complete details on:

• What data is collected
• How it's used (anti-counterfeit, warranty, product improvement, support)
• Who has access (Lucky Jade, service providers, OEM partners)
• How long it's retained (90 days raw data, aggregates longer)
• Your rights (access, deletion, export under GDPR/CCPA)

3.2 Data We Do NOT Collect

We explicitly do NOT collect:

• Wallet addresses, private keys, or cryptocurrency credentials
• Mining pool credentials or API keys
• Personal browsing history outside our website
• Financial information (payments handled by third-party processors)

4. Intellectual Property

4.1 Trademarks

Lucky Jade Miner™, Hash Processing Unit™, HPU™, Twin Jade™, and Solo Card™ are trademarks of Lucky Jade Mining Corp. All rights reserved.

4.2 Driver Software

Open-source driver software is provided under GPL-3.0 license. See driver package for full license text.

4.3 Hardware Designs

Hardware designs, schematics, PCB layouts, and manufacturing specifications are proprietary and confidential. Reverse engineering, copying, or unauthorized reproduction is strictly prohibited.

5. Prohibited Conduct

You agree NOT to:

• Tamper with, modify, or remove the hardware UUID or EEPROM security features
• Attempt to clone, counterfeit, or produce unauthorized Lucky Jade hardware
• Remove or circumvent anti-counterfeit cryptographic signatures
• Use products for illegal activities (fraud, money laundering, etc.)
• Resell products with modified firmware or tampered security features
• Exceed electrical or thermal specifications (may void warranty)

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

LUCKY JADE MINING CORP IS NOT LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Lost profits, lost mining revenue, or cryptocurrency market losses
• Data loss or corruption
• Damages from third-party services (mining pools, electricity costs, network outages)
• Cryptocurrency price fluctuations or mining difficulty changes
• Downtime, interruption of service, or performance degradation

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT.

Note: Some jurisdictions do not allow limitation of liability for consumer products. If you are a consumer in the European Union or other jurisdiction with consumer protection laws, certain limitations above may not apply to you.

7. User Rights (GDPR & CCPA)

7.1 Access to Your Data

You may request a copy of all data we hold about your hardware UUID. See our Privacy Policy for details.

7.2 Data Deletion

You may request deletion of personal data linked to your UUID. Note: The UUID itself will be retained in anonymized form for anti-counterfeit protection, but dissociated from any personal identifiers.

7.3 Data Portability

You may export your telemetry data in JSON format via your account dashboard.

8. Telemetry Opt-Out Procedure

8.1 How to Disable Telemetry

You may disable telemetry via:

• Command line: jade config set telemetry.enabled false
• Account dashboard: Settings → Privacy → Disable Telemetry
• Configuration file: Edit /etc/jade/config.toml

8.2 Consequences

8.3 Re-Enabling Telemetry

You may re-enable telemetry at any time using the same methods above. Warranty coverage resumes for the period telemetry is active.

9. Regional Compliance

9.1 GDPR (European Union)

EU users have additional rights under the General Data Protection Regulation. See our Privacy Policy for GDPR-specific information.

9.2 CCPA (California)

California residents have rights under the California Consumer Privacy Act. See our Privacy Policy for CCPA-specific information.

9.3 Export Controls

Products contain cryptographic technology and may be subject to U.S. export control laws. You are responsible for compliance with applicable export laws in your jurisdiction.

10. Amendments

We may update these Terms at any time. Material changes will be notified via email (if you registered an account) or website notice for 30 days. Continued use after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of laws principles.

Note: EU consumers may have mandatory consumer protection rights that override certain provisions of these Terms under EU law.
